Terms & Conditions:
1. Domains
1.1. Domain purchases must be paid for in full by the "Date Due" or the domains will become the property of NBS Studio.
1.2. You (the client) will be issued with a "Proforma" invoice for any Domain(s) requiring Renewal. The "Date Due" will be the same date as the "Renewal Date". This invoice will be sent out 1 month prior to the Renewal of the Domain(s). (See also "Payments")
1.3. Domains will not be renewed if payment for those domains is not received by their "Renewal Date".
1.4. .UK Domains will still remain active for a period of 3 months after the "Renewal Date". During this period you will still have opportunity to renew your domain(s) before the domain is released for re-registration to the public.
1.5. .COM domains will be canceled on or after 7pm the evening prior to the expiry / renewal date if payment is not received. You (the client) will have a 1 month period to renew your domain before it becomes available to the public for registration.
1.6. In purchasing a domain name You (the client) will be solely liable as the domain owner if any ownership rights or trademark violations occur. If we are legally requested to suspend a domain we will do so and inform you of our action. We will not act as arbitrators in any dispute action that will be taken and you will be legally held liable for any legal costs or otherwise that are incurred by NBS Studio if NBS Studio is drawn in to any dispute action.
1.7. It is your sole responsibility to check that any domain name(s) you purchase are in no wise infringing any person or companies rights. You will also agree that NBS Studio will not be held liable for any dispute regarding a domain name(s).
1.8. NBS Studio will not carry out any analysis of a domain name or the content on your website to deem if any infringement of a persons rights or trademark has occurred. It will be Your (the clients) responsibility to carry out any research.
1.9. NBS Studio will from time-to-time view websites hosted to see if any breach of NBS Studio's "Terms & Conditions" have been breached. If a breach has been found the website will be frozen until any content has been either amended or removed. If a website is hosted by an alternative provider and NBS Studio is providing DNS services, NBS Studio will amend the DNS to prevent the site from being publicly viewed if a breach of NBS Studio's "Terms & Conditions" is found.
2.0. All outstanding invoices must be paid for in full prior before any Domain(s) will be Transfered out from NBS Studio control.
2. Hosting
2.1. You (the client) will agree when purchasing hosting with NBS Studio, that You (the client) will not hold NBS Studio liable in any manner for downtime caused to a hosted website if it was beyond the control of NBS Studio.
2.2. You (the client) will agree when purchasing hosting with NBS Studio, that You (the client) will not hold NBS Studio liable in any manner for data loss, loss of business, or access gained to sensitive information if the loss or access gained was out of NBS Studio's control.
2.3. You (the client) will not hold NBS Studio liable for any loss of data, loss of business, or access gained to sensitive information if it has occurred due to a computer virus / trojan horse program or by the actions of a computer hacker.
2.4. Hosting will be suspended after 7 days from the the "Renewal Date" or "Date Due" as stated on the invoice if payment has not been received.
2.5. After a period of 14 days if payment for Renewal has not been received the hosting account will be terminated including any related services. Any domains linked to the hosting will be either held until their renewal date in which they will either be canceled or transfered to an alternative provider on request.
3. Termination of Contract
3.1. Your contract will be automatically terminated if it is found that you have carried out the following;
a) Been in breach of a Trade Mark or have Infringed someone's rights in regard to a domain name.
b) Not paid any outstanding debts with NBS Studio in a timely manner.
c) You have used the site to send unsolicited messages either via email or server side scripting.
d) You have used a computer bot, virus or trojan horse from your website.
e) You have created content on your website that infringes the rights of NBS Studio in any manner.
f) The content on your website was found to be either; Sexually explicit, Violent, Abusive, Religious hatred, or any other manner that NBS Studio classes as immoral in any manner.
g) You have acted as a third-party to NBS Studio services, acting as a reseller, without prior written permission of NBS Studio.
4. Payments
4.1. A "Proforma" invoice will be sent out 1 month prior to the renewal of either a domain name or other hosting services. You (the client) must ensure that the invoice is paid in full by the "Date Due" if you wish to continue with either your domain name(s) and/or hosting services.
5. Cancellation
5.1. You (the client) do not need to sent a notification to NBS Studio to cancel a domain name. It would be deemed as polite if You (the client) did so, but it is not required. Failure to pay a "Proforma" invoice by the "Date Due" will constitute as termination of any related services.
5.2. If You (the client) wish to send notification of cancellation, You (the client) must inform NBS Studio in writing by either email; at or post; NBS Studio, 12 Kempson Drive, Great Cornard, Sudbury, Suffolk, CO10 0ND. Telephone is not the accepted method.
6. Client Agreement
6.1. In requesting either products or services from NBS Studio you thereby show that you have read and agreed to become legally binding to these "Terms & Conditions". You (the client) do not have the right to alter any of these "Terms & Conditions" without prior written approval before such products or services are agreed to be provided.
6.2. A contract will either be in the form of "Written request by email" or "Signed Contract". Either of these will constitute as a formal contract between NBS Studio and You (the client), and will be taken as an acceptance of these "Terms & Conditions".
6.3. Any contract formed by NBS Studio and You (the client) will be binding and governed in accordance to English law and the jurisdiction of the English courts.
